Ausbiz Capital Investments Pty Ltd (ABN 92 681 118 212) respects your privacy. This policy explains what personal information we collect, why we collect it, how we use and protect it, and the choices you have. We handle your information in line with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the Notifiable Data Breaches scheme, and the Spam Act 2003 (Cth) for marketing messages.

1. Who we are

Ausbiz Capital Investments Pty Ltd (ABN 92 681 118 212) is a Corporate Authorised Representative (CAR #1314938) of River X Financial Services Pty Ltd (ABN 26 674 273 011, AFSL 556458). We provide general financial product advice and managed investment solutions. We operate under a general advice model, so the information we provide does not take account of your personal objectives, financial situation or needs, and is not personal financial advice. Please consider your own circumstances, read the relevant disclosure documents, and consider seeking advice from a licensed financial adviser before acting on any information we provide.

2. What information we collect

  • Identity and contact details: your name, email address, phone number, postal address, and identification documents we need to verify who you are.
  • Financial and investment details: your financial circumstances, investment preferences, and risk tolerance.
  • Account and transaction information: records of the products you hold or enquire about and your dealings with us.
  • Technical and usage data: your IP address, device and browser type, and how you use our website, collected through cookies and similar tools.
  • Sensitive information: we collect sensitive information only with your consent and where it is reasonably necessary for our services.

3. How we collect your information

  • Directly from you: when you complete a form, subscribe, create an account, or contact us by phone, email or in person.
  • Automatically: through cookies, analytics and tracking tools as you use our website.
  • From third parties: from our AFSL licensee, service providers, referrers, or public sources, where you have consented or the law allows. If we collect your information from someone else, we take reasonable steps to let you know.

4. Why we collect and use your information

  • To provide our services: set up and administer your account, respond to enquiries, and deliver investment information and updates.
  • To meet legal obligations: including the Corporations Act, anti-money laundering and counter-terrorism financing (AML/CTF) laws, and tax and record-keeping rules.
  • To improve our website and services: understand how our site is used and improve your experience.
  • To market to you: send you news, insights and offers about our products and services, where you have consented or the law otherwise permits (see section 5).

5. Marketing and electronic messages

We may contact you by email, SMS, phone or post, including with marketing about our products, services, news and offers.

  • Your consent: When you give us your email address or phone number (for example by completing a form, subscribing, creating an account, or otherwise dealing with us), you agree that we may contact you at those details, including by email, SMS and phone, for marketing and other purposes, unless you tell us otherwise.
  • Identifying us: every marketing message identifies Ausbiz Capital and includes a way to contact us.
  • Opting out: you can opt out at any time. Use the unsubscribe link in any email, reply STOP to an SMS, or contact us using the details in section 14. We action opt-out requests promptly, and within five business days at the latest.
  • After you opt out: we may still send you messages we are required or permitted to send, such as account, transaction or legal notices.

6. How we protect your information

We take reasonable technical and organisational steps to protect your information from misuse, interference, loss, and unauthorised access, modification or disclosure. These include restricting access to authorised personnel, using encryption and secure storage, and reviewing our security practices regularly. No system is completely secure, so we cannot guarantee absolute security.

7. How long we keep your information

We keep personal information only for as long as we need it for the purposes in this policy or to meet our legal obligations. Some financial and identity records must be kept for set periods (for example, at least seven years under AML/CTF and tax laws). When we no longer need information, we take reasonable steps to delete or de-identify it.

8. Sharing and disclosure

We disclose personal information only where needed, including to:

  • Our AFSL licensee, River X Financial Services Pty Ltd, for compliance and supervision.
  • Service providers who support our business (for example IT, hosting, CRM, and email and SMS platforms, and professional advisers), under confidentiality obligations.
  • Regulators, courts, or law enforcement where required or authorised by law.
  • A buyer or successor entity in connection with a sale, merger or restructure of our business.

We do not sell your personal information.

9. Overseas storage

Some of the service providers and cloud platforms we use may store or process data on servers located outside Australia. Where this happens, we take reasonable steps to ensure your information is handled consistently with the Australian Privacy Principles.

10. Cookies and analytics

Our website uses cookies and similar technologies to keep the site working, remember your preferences, and measure traffic. You can refuse or delete cookies through your browser settings, but some features may not work properly.

11. Accessing and correcting your information

You can ask for a copy of the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Contact us using the details in section 14. We will respond within a reasonable time, usually within 30 days. If we cannot give you access or make a correction, we will explain why.

12. Children's privacy

Our services are intended for adults. We do not knowingly collect personal information from anyone under 18 without parental consent.

13. Data breaches

If a data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.
